Terms and conditions

The following Terms and Conditions (T&Cs) describe your rights and responsibilities when using our online Platform (the “Platform”).

If you are accessing or using the Platform on behalf of your company, you represent that you are authorized to accept these T&Cs, and any additional terms such as subscription packages and pricing that will apply to your use of the platform, on behalf of your company, and all references to “you” or “the subscription holder” reference your company.

By indicating your acceptance to the T&Cs or visiting our website and accessing the information, resources, services, and tools we provide, you are agreeing to be bound by all terms, conditions, and notices contained or referenced in the T&Cs. If you do not agree to this, please do not use the Platform.

We reserve the right to revise the T&Cs at any time without prior notice to you, although we will endeavor to inform all users of revisions/additions at the time they are made.

The continued use of the Platform, following notification of these revisions, is considered acceptance of any modifications of the T&Cs.

 

  1. Subscriptions and payment policies 

  1. In order to use and access the Platform, you are required to subscribe. Subscription details and fees for services are explained on the website (Pricing – MRView) and in the pricing structure documentation, which also includes details of payment policies.

 

  1. Privacy & Compliance 

  1. Any personal information obtained from participants through the use of the Platform must be treated confidentially, used for the purpose of facilitating the meetings only, and cannot be disclosed to any person or entity outside of the subscription holder without consent from the participant. It is the sole responsibility of the subscription holder to ensure that all privacy regulations are adhered to in the use of the Platform.
  2. The subscription holder agrees to conduct all meetings, and use all data collected or received through the use of the MRView platform, in accordance with local laws, ordinances, regulations, guidelines and codes of conduct.
  3. In turn, MRView will treat any and all information shared with the Platform for the purposes of meeting set-up, subscription payment details, and recordings of meeting as strictly confidential, and the sole property of the subscription holder.
  4. Our Privacy & Cookies policy sets out: (a) the terms on which we process any personal data we collect from you, or that you provide to us; (b) information on data security and compliance; and (c) information about the use of cookies on the Platform, which also apply to your use of the Platform. By using the Platform, you consent to such processing and the confirm that all data provided by you is accurate. Details can be found in our privacy policy (Privacy policy – MRView).

 

  1. Publicity

  1. The subscription holder consents that MRView may identify you as a customer of MRView and generally describe the product and services it provides to customer on its website, promotional materials, presentations and proposals to other customers, both current and potential. Customers would be permitted to withdraw this permission at any time.

 

  1. Copyrights

  1. All content and materials available on MRView, including, but not limited to website name, images, logos, text and graphics are intellectual property of MRView and are protected by applicable copyright law. Any inappropriate use, including and not limited to the reproduction, display or distribution of any content on the site is strictly prohibited, unless specifically permitted by MRView.

 

  1. Limitation of responsibility 

  1. Use of the Platform is on the understanding that the Platform itself, along with the services provided, are offered as seen. This means that we do not guarantee that:
  2. The Platform will be uninterrupted, or free from errors.
  3. The Platform will meet your needs or requirements.
  4. Any defects in the operation or functionality of any resources we provide will be repaired or corrected.
  5. In addition to the above, you expressly understand and agree, that any claim against MRView cannot exceed the amount paid to MRView for the use of our Platform. Nor will MRView be liable for any direct, indirect, or incidental loss or damages incurred as a result of using the Platform.
  6. You also agree to indemnify and hold harmless MRView, parent companies, and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of the T&Cs or the failure to fulfil any obligations relating to your account incurred by you.

 

  1. Account Security 

  1. The Username and password provided to the subscription holder along with any other piece of information as part of our security procedures, must be treated as confidential, and you must not disclose it to any other person or entity.
  2. You also acknowledge that your account is personal to you and agree not to provide any other person with access to it or portions of it using your username, password, or other security information.
  3. You access the internet at your own risk.
  4. You agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security. You also agree to ensure that you log out of your account at the end of each session.
  5. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

 

  1. Monitoring, Enforcement and Termination 

  • By accessing the information, resources, services, products, and tools provided by the Platform, either directly or indirectly, you agree to use them only for the purposes intended as permitted by (a) the T&Cs and (b) applicable laws, regulations and generally accepted online practices or guidelines.
  • Wherein, you understand that:
  • You are responsible for maintaining the confidentiality of any login information associated with any account you use to access our Platform. Accordingly, you are responsible for all activities that occur under your account/s.
  • Accessing (or attempting to access) the Platform by any means other than through the means we provide, is strictly prohibited. You specifically agree not to access (or attempt to access) the Platform through any automated, unethical or unconventional means.
  • Engaging in any activity that disrupts or interferes with the Platform, including the servers and/or networks to which our Platform are located or connected, is strictly prohibited.
  • Attempting to copy, duplicate, reproduce, sell, trade, or resell our Platform is strictly prohibited.
  • You are solely responsible for any consequences, losses, or damages that we may directly or indirectly incur or suffer due to any unauthorized activities conducted by you.
  • You agree that you will not upload, post, share, or otherwise distribute any content that:
  • Is illegal, threatening, defamatory, abusive, harassing, degrading, intimidating, fraudulent, deceptive, invasive, racist, or contains any type of suggestive, inappropriate, or explicit language.
  • Infringes on any trademark, patent, trade secret, copyright, or another proprietary right of any party.
  • Contains any type of unauthorized or unsolicited advertising;
    Impersonates any person or entity, including any MRView employees or representatives.
  • We have the right at our sole discretion to remove any content that we feel in our judgment does not comply with the T&Cs. We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.
  • We do not assume any liability for any content posted by you or any other 3rd party users of our website.

 

  • MRView has the right to:
  1. Disable any username, password or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of the T&Cs.
  2. Disclose your identity or other information about you to any third party who claims, pursuant to and in accordance with a statutory legal process, that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
  3. Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Platform.
